10. Security and Password

If you have an unpaid balance, we reserve the right to keep your account active and limit its functionality until all outstanding amounts are paid in full. Failure to settle outstanding balances may result in legal action or debt collection efforts.

14. Governing Law

Dispute Resolution & Arbitration

Any disputes arising from these Terms shall be resolved through binding arbitration in Texas, rather than in court. The arbitration shall be conducted under the rules of the American Arbitration Association (AAA). Both parties waive their right to a jury trial and agree that arbitration is the exclusive remedy, except for claims of intellectual property infringement.

This site is controlled from our offices in Texas, United States. While it may be accessible worldwide, by using this site, you agree that the laws of the State of Texas, without regard to its conflict of law principles and excluding the United Nations Convention on the International Sale of Goods, will govern all matters related to your use of the site and any purchases made through it.

In any legal action to enforce these Terms, the prevailing party is entitled to recover costs and attorney’s fees. Any claim you bring against us or our affiliates must be filed within one year of the event occurring, or it will be permanently barred.

Product Terms

These Product Terms apply specifically to the use of our API Products and Services and are in addition to the general Terms of Use. By using our API Products and Services, you agree to abide by these terms. In the event of any conflict, these Product Terms shall take precedence for API-related matters.

Resellers may use our platform under these Terms but are fully responsible for ensuring their users comply with all restrictions outlined here. Abuse, misuse, or unauthorized caching by resellers or their users will result in account suspension or termination.

General

The following terms apply to all APIs unless otherwise stated in their individual sections.

Attribution Requirement:
- All applications, services, or derivative works using data from the API must include proper attribution:
  “© Slpy © OpenStreetMap contributors”.
- Attribution must be clearly visible in any displayed map, printed output, or digital rendering of API data.
- Failure to provide proper attribution may result in restricted access or termination of API usage.
Data Usage Restrictions: Data retrieved from the API can be used to create derivative works, such as map images or printed maps for direct and immediate purposes (e.g., displaying in a newspaper). However:
- Sale, redistribution, or reuse of standalone maps or images outside their original context for commercial purposes is strictly prohibited.
- Data must not be stored, cached, or held beyond the initial use for creating derivative works.
- Data cannot be used for direct marketing, telemarketing, or any form of unsolicited outreach that is restricted under applicable U.S. state laws.
- Resellers must ensure that their users do not engage in unauthorized data storage, resale, or misuse.
Data Privacy: User data collected, processed, or transmitted through the APIs must comply with:
- Our company's Privacy Policy.
- All applicable local, national, and international privacy laws and regulations.
- Resellers are responsible for ensuring compliance with privacy laws for their users.
Rate Limiting: To maintain service quality, API usage is subject to rate limits. Any attempt to bypass these limits (e.g., using multiple accounts or proxies) may result in immediate suspension or termination.
Data Integrity: Developers must maintain the accuracy and integrity of data transmitted through the API. Any manipulation, modification, or misrepresentation of data that violates our standards may result in access restrictions or termination.
Third-Party Regulations: API users must prohibit third parties from:
- Storing, caching, or using API data for unauthorized purposes.
- Developing, testing, or improving competing products or databases.
- Resellers are responsible for ensuring their customers adhere to these restrictions.
Policy Violations: Violations may result in temporary or permanent suspension of access to our services. In severe cases, we may pursue legal action against violators, including resellers who fail to enforce these policies with their users.

Search API

User-Initiated Activity: All calls to the Search API must be initiated by explicit user activity, including but not limited to:
- Clicks, taps, keypresses, voice commands, and gestures.
- Automated or preloaded requests without user interaction are strictly prohibited.
No Storage or Caching of Data: Data retrieved through the Search API must not be stored, cached, or held beyond the immediate need of the user-initiated request. Additionally:
- Data must not be used to develop, test, or enhance other products or databases.
- Resellers must enforce this restriction with their users.

Maps API

Restricted Storage or Caching of Data: Data retrieved through the Maps API may only be stored or cached:
- On end-user devices for offline use, limited to a maximum period of 30 days.
- Beyond this timeframe, data must be deleted automatically.

Refund Policy

Slpy is committed to offering you robust, effective, and efficient mapping and search solutions for your needs. However, we understand that there may be times when our service does not live up to your expectations due to unforeseen circumstances. Therefore, we've designed our refund policy with you in mind.

1. Refund Eligibility:

Refunds are eligible under the following conditions:

You have been charged greater than $10 for Slpy credits that were exclusively used for services that were in error or malfunctioning. This means services were not working as described in our documentation and led to unsuccessful operations.
The error or malfunction must be reported to our technical support team within the current billing cycle in which it occurred. Refunds will only cover credits charged during the same billing cycle.
These errors or malfunctions are acknowledged and confirmed by our technical support team after proper investigation.

Please note that Slpy's policy does not consider a refund for:

Credits that have been consumed for successful API operations.
Issues arising from the misuse of the API, non-compliance with Slpy's documentation and guidelines, or errors in your application or platform.
Situations beyond Slpy's control, such as natural disasters, internet outages, etc., that may affect service availability.
The cancellation of your Pro plan subscription, as all Pro plan charges are non-refundable and are billed in advance on a monthly basis.

2. Requesting a Refund:

To request a refund, you should contact our customer support team via the Accounts and Billing Forum with:

The detailed description of the service error
The time period during which the error occurred
The number of credits charged during this period

The support team will investigate the issue and respond within 5-7 business days. If your claim is validated, we will initiate a refund process.

3. Refund Process:

Once your refund request is approved:

Slpy will refund the equivalent amount of the credits affected during the service malfunction. The refund will be issued to your original payment method used for the purchase, unless otherwise agreed upon.
Please allow 7-14 business days for the refund to reflect in your account. This period may vary based on your payment provider's policies.

4. Modifications to the Refund Policy:
